Industry Experience

Toby has experience in a wide range of taxation issues in focusing on mergers and acquisitions, in particular the negotiation of sale documentation, capital management strategies, structuring of investments for private equity investors and their unwind, employee share and option plans and drafting of tax sharing and tax funding agreements.

Recent matters that Toby has advised on include Coles Myer in relation to its 2005 and 2006 buy-back, Transurban’s takeover of Hills Motorway, the acquisition of Wizard Home Loans by GE Capital, ANZ and IFM on private equity investments and Centro on investments in US REITs. 

Professional Background

Toby holds a Bachelor of Jurisprudence, Bachelor of Laws and Bachelor of Commerce from the University of Western Australia.  Toby is also a fellow of the Taxation Institute of Australia.
